Terms of Service

Effective 2026-10-26.

These terms are between you (and the business you act for) and Carrier Archive ("we", "us"). You accept them when you open an account or track a carrier; the sign-in and tracking forms say so and link here, and we record which version you accepted. Looking up a carrier without an account is subject to sections 2, 3, 7 and 8.

1. The service

We look up, monitor and keep dated records of information about motor carriers from public U.S. government files, chiefly FMCSA's. Every fact names the file it came from and the date that file showed it.

2. What the service is not

Not a safety certification: a page, alert or record documents what the cited federal files showed, not that a carrier is safe, reliable or suitable for any load. Not a judgement about a carrier: marked record patterns are documented patterns in government records, not a finding that a carrier is fraudulent or unfit. Not legal advice. Not identity verification. Not real-time: the federal files are checked daily and can themselves trail real-world events. Not a carrier selection service: we do not select, recommend or endorse carriers and take no part in your decision to use one. A filing on record is not proof that a policy is in force for a particular load; verify critical facts with FMCSA and the insurer.

3. Permitted and prohibited use

Use the service only to evaluate a motor carrier's business operations in connection with transporting property. You may not use it, or any data from it, to decide any individual's eligibility for employment or engagement (including any driver, owner-operator or independent contractor), for credit or insurance underwriting about an individual, for housing decisions, or for any other purpose that would make the data a consumer report under the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) or similar state law. Carrier Archive is not a consumer reporting agency. You also may not resell or redistribute the data as a dataset, scrape or systematically extract the site, present a record as a government document, strip citations or disclaimers from a record you share, or use the service to harass anyone. We may suspend or close an account used in these ways.

4. Accounts and alerts

An account is opened with a verified email address and is the responsibility of the person who opens it. Alert settings are per person; a person can switch their own alerts for a carrier off. Keeping at least one person's alerts on for each carrier you rely on is your responsibility. We do not guarantee delivery of any email or availability of any government file on any day. Removing a carrier stops its checks; the history already recorded stays.

5. Plans and the beta

Free: lookups without an account; tracking up to 10 carriers per account; records included. During the beta there is no paid plan: an account needing more can be raised at no charge, in steps, and the paid terms are shown before the raise and confirmed by email. When charging begins ($99 per month for up to 100 tracked carriers, plus $20 per month per further 100), every raised account is emailed at least 30 days beforehand with the date, the price for what it is then tracking, and that a card must be on file by that date; an account with no card on file by then is paused above the free allowance, not charged. Prices and allowances may change with 30 days' notice by email. When paid plans exist: the price and allowance are shown before you authorize payment; the subscription renews monthly until you cancel, which you can do at any time from your dashboard, with paid service continuing to the end of the period paid; no refund of partial months when you cancel, except where the law requires it; if we end paid service early other than for your breach, we refund the unused part. When paid service ends above the free allowance you have 7 days to choose which carriers stay on; the rest are paused, not deleted.

6. Records and retention

Records state what the federal files showed on stated dates and carry a fingerprint that can be checked at carrierarchive.com/verify; the fingerprint shows the document is the one we issued and unaltered, not that the underlying government data is accurate, and does not by itself establish admissibility. Records we issued, and the monitoring and alert history behind them, are kept for 7 years on every plan, free included. Your dashboard lists your most recent records and alerts while the account is open; anything older, the fuller history behind a record, and everything after the account is closed, is sent on request to support@carrierarchive.com. Closing your account does not shorten this. Your own legal and insurance retention requirements may be longer; keeping your own copies is your responsibility. A carrier disputing a federal record corrects it with FMCSA; our later checks reflect the correction, dated.

7. Disclaimers and limits on liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, OR THAT ANY ALERT, RECORD OR GOVERNMENT DATA IS ACCURATE, COMPLETE OR TIMELY. TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOST PROFITS, LOST CARGO, LOST BUSINESS OR THIRD-PARTY CLAIMS ARISING FROM THE SERVICE OR ANY DECISION MADE IN RELIANCE ON IT, AND OUR TOTAL LIABILITY FOR ALL CLAIMS TOGETHER IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND $100.

Where a state does not allow a limit, it applies as far as that state's law allows. You will cover us for losses and reasonable legal costs arising from your breach of section 3 or from a third party's claim arising from a decision you made using the service.

8. Ownership, changes, law

The government data is public; the site, its software, presentation and archive are ours; you may share records you obtained in the ordinary course of business with citations and disclaimers intact. We may change these terms with 30 days' notice by email for a material change; continuing to use the service after that is acceptance; changes do not shorten the retention promised for records already issued. We may close an account for breach of these terms, with notice where practical; closure by either side does not shorten section 6. Florida law governs; disputes between you and us are brought in the state or federal courts located in Florida.
